Government Control

In most regions of India, skill-based games are allowed, but games of chance (also known as gambling) are considered immoral, and thus are forbidden in many areas. Because betting and gambling are state-regulated activities, each state has its own set of laws.

 

All states in India clearly prohibit gambling and playing games of chance, with an exception of Goa, Sikkim, and the Union Territory of Daman. Games of skill have also been restricted in Andhra Pradesh, Assam,  Nagaland, Odisha, Telangana and Tamil Nadu.

That being said, while owning and operating Indian online casino sites that are based in the country might not be legal, there is nothing that the law says about playing in offshore casinos (except in Telangana and Andhra Pradesh). Game Of Chance And Game Of Skill

India separates the games into two basic categories in classifying them. A game can be defined as either a chance game or a skill game.

Some games may also need even some advanced training in order to succeed. These are the games that are legal in the majority of Indian states. Moreover, if a gambling game demands a certain level of a particular competency, it may not even be prohibited at all. Although, such gambling games attract also a lot of judgment.

Laws Currently In Force

Currently, the government has approved three laws that apply to the entire country. The Public Gambling Act of 1867, the Prize Competition Act of 1955, and the Information Technology Act of 2000 are the three statutes in question. Each of them was implemented and passed into law years before the iGaming business grew to its current size.

  • The Public Gambling Act of 1867 is severely obsolete since it prohibited all kinds of gambling in India at the time it was issued. However, many regard it as a breach because the internet did not exist at the time, therefore it does not apply.
  • The Prize Competition Act of 1955 prohibits any prize competition with a prize pool of more than one thousand rupees a month.
  • Information Technology Act of 2000 neither explicitly prohibits nor defines online casino as an illegal activity.

Sikkim and Goa are the only states in India that have chosen to adopt definite legislation on online gambling, with the Sikkim Online Gaming (Regulation) Act of 2008 allowing players to experience a crypto casino in India online.

Some claim that India’s need to regulate internet gambling might have a significant influence on the country’s overall economy.
